What is a cadastral report?
A land registry search is a procedure that allows us to access the data contained in the land registry archives. This enables us to see who is listed as the owner of a parcel of land or a property. However, the name listed in the land registry has no legal standing as proof of ownership (with the exception of certain Italian provinces); ownership can be proven through the real estate registry, which can in turn be consulted via a land registry search. A professional authorized by the owner may also access the floor plan of a building registered in the building registry.

What is a cadastral transfer?
An application for a title transfer filed with the land registry serves to indicate that the owner of a property has changed and to update the land registry records. This may occur following a transfer of ownership of a home, the transfer of a usufruct in cases where automatic consolidation is not provided for or does not occur, or in the event of an inheritance. In the case of inheritance, this procedure is the responsibility of the private parties involved; for deeds drawn up, received, or authenticated by notaries, the notaries are responsible for this procedure.

What does it mean to file a cadastral amendment?
The Cadastral Record must be updated after completing a renovation, including work carried out under the Superbonus program when the cost is significant or when the interior layout of the property has been altered. The cadastral update must be completed within 30 days of the end of the work to avoid penalties. Another situation in which an update is required is when a property is subdivided, creating new urban real estate units. To file a change report, you must seek the assistance of a licensed technical professional. It is important to keep the cadastral data up to date to avoid potential building code violations if the data does not match the floor plans submitted to the municipality to obtain the building permit.

What does it mean to register a building with the land registry, and when is it necessary?
Once a new construction project is completed, various documents are required before the certificate of occupancy can be obtained, including proof that the property has been registered with the land registry. Furthermore, without completing this procedure, the municipality cannot assign a street number to the new building. So, how should we proceed? Through a digital process, a licensed technician can prepare a floor plan and complete the land registry filing once authorized by the client.

What are the implications of my property's cadastral category and class?
The land registry divides all properties into 6 broad categories (with many subcategories) based on the function and characteristics of each building. Each subcategory denotes a specific type of building, which is in turn organized into a series of classes that indicate the property’s value and the centrality of its location. The category and class are determined through the registration process and may be adjusted based on change reports. All of this is important because it determines the property’s cadastral income and serves as the basis for calculating the related taxes.

How can I correct an error in the cadastral data for my property?
If we find errors in the data related to the property in question, it is possible to file an appeal through the Revenue Agency’s online portal. To manage this process, you may appoint a professional who can assist you in navigating the various bureaucratic procedures. In the event of errors in the floor plan, you will need to submit a new floor plan that accurately reflects the current state of the property, and, if necessary, apply for regularization.
